利用規約

本利用規約（以下「本規約」といいます）は、f∞ studio（以下「当方」といいます）が提供するモバイルアプリケーション「Pangraphy」（以下「本アプリ」といいます）の利用条件を定めるものです。本アプリを利用する全てのユーザー（以下「ユーザー」といいます）は、本規約に同意したものとみなされます。

第1条（適用）

  1. 本規約は、ユーザーと当方との間の本アプリの利用に関わる一切の関係に適用されます。
  2. 当方が本アプリ上で個別に定める規定がある場合、当該規定も本規約の一部を構成します。

第2条（本アプリの概要）

本アプリは、ユーザーが「これも写真？」と感じる被写体を投稿し、他のユーザーが3段階のタグ（「これは写真」「これも写真？」「これは写真ではない」）で評価することにより、写真の境界を集合知として可視化するアート・リサーチを目的としたサービスです。

第3条（アカウント登録）

  1. ユーザーは、本アプリの提供する認証方法（Google サインイン、Sign in with Apple、ゲスト参加）のいずれかにより、本アプリを利用できます。
  2. ゲスト参加（匿名認証）の場合、アカウントは利用端末にバインドされ、端末の紛失・初期化等により復元できなくなる場合があります。
  3. ユーザーは、自己の責任においてアカウント情報を管理するものとします。

第4条（禁止事項）

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

  1. 法令または公序良俗に違反する行為
  2. 犯罪行為に関連する行為
  3. 当方、他のユーザーまたは第三者の知的財産権、肖像権、プライバシー、名誉その他の権利または利益を侵害する行為
  4. 第三者になりすます行為
  5. わいせつ、グロテスク、暴力的、差別的、ヘイトスピーチに該当する内容の投稿
  6. 自身に著作権その他の権利のない写真の投稿
  7. 商業目的の宣伝、勧誘、スパム
  8. 本アプリのシステム・他のユーザーのアカウントを不正に操作する行為
  9. 本アプリのリバースエンジニアリング、改変、複製
  10. その他、当方が不適切と判断する行為

第5条（投稿コンテンツ）

  1. ユーザーは、本アプリに投稿するコンテンツ（写真、テキスト、タグ、コメントを含みます。以下「投稿コンテンツ」といいます）について、必要な権利を有していることを表明し保証します。
  2. ユーザーは、当方に対し、投稿コンテンツを本アプリの提供および改善のために必要な範囲で、無償・非独占的に利用（複製、公開、配信、表示を含みます）する権利を許諾します。
  3. 当方は、投稿コンテンツが本規約に違反すると判断した場合、ユーザーへの事前通知なく、当該コンテンツを削除または非表示にすることができます。

第6条（本アプリの提供の停止等）

当方は、以下のいずれかの事由があると判断した場合、ユーザーに事前に通知することなく本アプリの全部または一部の提供を停止または中断することができます。

  1. 本アプリにかかるシステムの保守点検または更新を行う場合
  2. 地震、落雷、火災、停電、天災等の不可抗力により、本アプリの提供が困難となった場合
  3. その他、当方が本アプリの提供が困難と判断した場合

第7条（利用制限およびアカウント削除）

当方は、ユーザーが以下のいずれかに該当する場合、事前の通知なく、当該ユーザーに対して本アプリの全部もしくは一部の利用を制限し、またはアカウントを削除することができます。

  1. 本規約のいずれかの条項に違反した場合
  2. 当方からの問い合わせに対して長期間返答がない場合
  3. その他、当方が本アプリの利用を適当でないと判断した場合

第8条（保証の否認および免責事項）

  1. 当方は、本アプリに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定目的への適合性、セキュリティなどに関する欠陥、エラー、バグ、権利侵害などを含みます）がないことを明示的にも黙示的にも保証しません。
  2. 当方は、本アプリに起因してユーザーに生じたあらゆる損害について、当方の故意または重過失による場合を除き、一切の責任を負いません。
  3. ユーザー間または第三者との間で生じたトラブルについて、当方は一切責任を負いません。

第9条（サービス内容の変更等）

当方は、ユーザーへの事前通知なく、本アプリの内容を変更し、または提供を中止することができます。

第10条（利用規約の変更）

当方は、必要と判断した場合には、ユーザーへの事前通知なく本規約を変更することができます。変更後の規約は、本アプリ内または当方の指定する方法で公表された時点から効力を生じます。

第11条（準拠法・裁判管轄）

  1. 本規約の解釈にあたっては、日本法を準拠法とします。
  2. 本アプリに関して紛争が生じた場合には、当方の所在地を管轄する裁判所を専属的合意管轄とします。

These Terms of Service ("these Terms") set forth the conditions for using the mobile application "Pangraphy" ("the App") provided by f∞ studio ("we", "us"). All users who use the App ("User", "Users") are deemed to have agreed to these Terms.

Article 1 (Application)

  1. These Terms apply to all relationships between the User and us regarding the use of the App.
  2. If we establish individual provisions on the App, such provisions shall also constitute part of these Terms.

Article 2 (Overview of the App)

The App is a service for art research aimed at visualizing the boundary of photography as collective intelligence. Users post subjects that they perceive as "Is this also a photo?", and other users evaluate them using three-level tags ("This is a photo", "Is this also a photo?", "This is not a photo").

Article 3 (Account Registration)

  1. Users may use the App using one of the authentication methods provided by the App (Google sign-in, Sign in with Apple, or guest participation).
  2. In the case of guest participation (anonymous authentication), the account is bound to the device in use and may become unrecoverable due to device loss, reset, etc.
  3. Users shall manage their account information at their own responsibility.

Article 4 (Prohibited Actions)

Users must not engage in any of the following actions when using the App:

  1. Actions that violate laws or public order and morals
  2. Actions related to criminal acts
  3. Actions that infringe on intellectual property rights, portrait rights, privacy, honor, or other rights or interests of us, other users, or third parties
  4. Impersonating a third party
  5. Posting content that is obscene, grotesque, violent, discriminatory, or qualifies as hate speech
  6. Posting photos for which the user does not have copyright or other rights
  7. Commercial advertising, solicitation, or spam
  8. Unauthorized manipulation of the App's system or other users' accounts
  9. Reverse engineering, modification, or reproduction of the App
  10. Other actions that we deem inappropriate

Article 5 (Posted Content)

  1. Users represent and warrant that they have the necessary rights to content posted to the App (including photos, text, tags, and comments; hereinafter "Posted Content").
  2. Users grant us a free, non-exclusive license to use Posted Content (including reproduction, publication, distribution, and display) to the extent necessary for providing and improving the App.
  3. We may delete or hide Posted Content without prior notice to the User if we determine that it violates these Terms.

Article 6 (Suspension of the App)

We may suspend or interrupt the provision of all or part of the App without prior notice to Users if we determine that any of the following circumstances exists:

  1. When performing system maintenance, inspection, or updates related to the App
  2. When the provision of the App becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  3. Otherwise, when we determine that the provision of the App is difficult

Article 7 (Usage Restrictions and Account Deletion)

We may, without prior notice, restrict all or part of a User's use of the App or delete the User's account if the User falls under any of the following:

  1. When the User violates any provision of these Terms
  2. When there is no response to our inquiries for an extended period
  3. Otherwise, when we determine that use of the App is not appropriate

Article 8 (Disclaimer of Warranty and Limitation of Liability)

  1. We do not guarantee, either expressly or implicitly, that the App is free from factual or legal defects (including defects, errors, bugs, rights infringements, etc. relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security).
  2. We are not liable for any damages incurred by Users arising from the App, except in cases of our intentional or gross negligence.
  3. We are not liable for any trouble that occurs between Users or with third parties.

Article 9 (Changes to Service Content)

We may change the content of the App or discontinue its provision without prior notice to Users.

Article 10 (Changes to Terms of Service)

We may change these Terms without prior notice to Users if we deem it necessary. The revised Terms shall take effect when published within the App or by a method designated by us.

Article 11 (Governing Law and Jurisdiction)

  1. The interpretation of these Terms shall be governed by the laws of Japan.
  2. In the event of a dispute regarding the App, the court having jurisdiction over our location shall be the exclusive court of first instance.
